Ferdy Sambo di Tuntutan Jaksa, Jaksa Agung Muda Tindak Pidana Umum (Jampidum) Kejagung Fadil Zumhana ogah disebut terjadi polemik setelah Jaksa Penuntut Umum (JPU) memberikan tuntutan kepada Ferdy Sambo Cs di kasus pembunuhan Brigadir Yosua.

Sehingga ia juga tidak sepakat dengan yang disampaikan rekannya, Kepala Pusat Penerangan Hukum Kejaksaan Agung (Kapuspenkum Kejagung), Ketut Sumedana. Ketut sebelumnya menyampaikan terjadi polemik setelah jaksa menuntut 5 terdakwa kasus pembunuhan Nifriansyah Yosua Hutabarat Ferdy Sambo di Tuntutan Jaksa.

“Yang ingin saya sampaikan tentang tinggi rendah tuntutan, saya enggak mau disebut polemik, Pak Ketut bilang polemik, enggak ada polemik, bagi saya kita ini beda sudut pandang,” ujar Fadil saat memberikan konferensi pers di Kejagung, Kamis (19/1/2023).

Meski demikian, perbedaan sudut pandang terkait tinggi atau rendahnya tuntutan ke Bharada E hingga Putri Candrawathi kata dia, merupakan hal yang wajar. Namun, Fadil menolak hal itu disebut sebagai polemik.Ia juga mengaku menghormati jika keluarga korban ada yang merasa tuntutan yang disampaikan jaksa ke pelaku dirasa ringan. Termasuk jika terdakwa merasa tuntutan tersebut ketinggan meruapakan hak terdakwa. “Ini kan proses masih berjalan, ada yang namanya pledoi, kita dengar. Ada replik yang disampaikan ada duplik, ada putusan, masih panjang,” jelas dia.

Dalam kasus ini, JPU telah menampaikan tuntutan kepada 5 terdakwa. Yakni Richard Eliezer atau Bharada E dituntut 12 tahun penjara. Kemudian Bripka Ricky Rizal dituntut 8 tahun penjara, Kuat Ma’ruf dituntut 8 tahun penjara. Putri Candrawathi dituntut 8 tahun penjara dan Ferdy Sambo dituntut penjara seumur hidup.

Buntut kasus pembunuhan Brigadir Nofriansyah Yosua Hutabarat atau Brigadir J, Eks Kadiv Propam Polri Ferdy Sambo dituntut penjara seumur hidup. Tapi tidak sedikit yang menyayangkan karena tidak dituntut hukuman mati, apa sih bedanya?

Tuntutan hukuman seumur hidup bagi Ferdy Sambo itu dibacakan tim jaksa pada sidang Selasa (17/1/2023). Sidang tuntutan dibacakan jaksa penuntut umum (JPU) setelah melalui proses panjang persidangan, memanggil saksi meringankan dan memberatkan hingga mendengar pembelaan tersangka atau terdakwa. “Menuntut supaya majelis hakim PN Jaksel yang memeriksa dan mengadili perkara ini memutuskan menyatakan terdakwa Ferdy Sambo terbukti bersalah melakukan dengan sengaja dan dengan rencana terlebih dahulu merampas nyawa orang lain,” kata jaksa membacakan tuntutannya.

“Menjatuhkan pidana terhadap Ferdy Sambo dengan pidana penjara seumur hidup, ” sambung jaksa. Mendengar tuntutan ini, Kuasa hukum keluarga Brigadir J atau Nofriansyah Yosua Hutabarat, Kamaruddin Simanjuntak menilai tuntutan jaksa tidak memenuhi rasa keadilan. Ini karena seharusnya Ferdy Sambo dituntut hukuman mati.

“Ferdy Sambo yang sudah menyengsarakan semua orang, membohongi presiden membohongi DPR, membohongi Kapolri dan lembaga lain, dan menyeret 97 polisi menjadi korban hanya dituntut seumur hidup. Melihat kualitas kejahatannya seharusnya hukuman maksimum yaitu hukuman mati,” kata Kamaruddin di Polda Metro Jaya, Jakarta, Rabu (18/1/2023). Sementara hukuman penjara seumur hidup Ferdy Sambo jadi perdebatan, banyak masyarakat yang belum paham apa itu hukuman penjara seumur hidup dan bedanya dengan hukuman mati. Selain itu, hukuman mati dianggap sebagai pidana khusus, karena didasari untuk menghindari tuntutan atau reaksi masyarakat yang bersifat balas dendam atau bersifat extra legan execution.

Putri Candrawathi Dituntut Ringan oleh Jaksa

Putri Candrawathi dituntut 8 tahun penjara oleh Jaksa Penuntut Umum (JPU) pada sidang pembacaan tuntutan di Pengadilan Negeri n Selatan, Rabu (18/01/2023). “Menjatuhkan pidana terhadap terdakwa Putri Candrawathi dengan pidana penjara selama delapan tahun,“ ujarnya. Mendengar tuntutan jaksa, penonton sidang langsung riuh menyoraki. Hal tersebut disinyalir karena tuntutan dinilai terlalu ringan. Hakim langsung mengingatkan agar para penonton tetap tertib dan sopan demi menjaga marwah persidangan. Istri mantan Kadiv Propam Polri Ferdy Sambo terbukti bersalah karena turut terlibat dalam pembunuhan Brigadir J atau Nofriansyah Yosua Hutabarat.

“Menyatakan terdakwa Putri Candrawathi terbukti bersalah melakukan tindak pidana turut serta melakukan pembunuhan yang direncanakan terlebih dahulu sebagaimana yang diatur dan diancam dalam dakwaan pasal 340 KUHP jo Pasal 55 Ayat (1) ke-1 KUHP,” kata jaksa dalam persidangan di Pengadilan Negeri (PN) Jakarta Selatan, Rabu (18/1/2023). Sebagaimana diketahui sebelumnya, pembunuhan berencana terhadap Brigadir Yosua atau Brigadir J dilakukan bersama suaminya Ferdy Sambo, Richard Eliezer atau Baharada E, Ricky Rizal dan Kuat Ma’ruf.

Pasal 340 berbunyi:

“Barang siapa sengaja dan dengan rencana lebih dahulu merampas nyawa orang lain, diancam karena pembunuhan dengan rencana, dengan pidana mati atau pidana penjara seumur hidup atau selama waktu tertentu, paling lama dua puluh tahun”. Pasca pembacaan tuntutan tersebut, tim kuasa hukum Putri Candrawathi akan lakukan pembelaan atau pledoi. Potongan video pembacaan tuntutan tersebar di media sosial, ragam komentar netizen memenuhi unggahan video tersebut. “Kecewa banget cuma 8 tahun, ” ujar akun bernama @Ameli. Selain itu beberapa juga berkomentar tentang mirisnya penegakkan hukum di Indonesia. Sebelumnya, Ricky Rizal dan Kuat Ma’ruf sudah dituntut 8 tahun penjara. Sementata Ferdy Sambo dituntut seumur hidup, kemudian Bharada E atau Richard Eliezer dituntut 12 tahun penjara.
